The Constitution Act

PREAMBLE

Humbly invoking the blessings of Almighty Notch, the players of the Minecraft Server do ordain and establish this Constitution.

This Constitution shall serve as the Supreme Law of the Minecraft Server. No other laws may supersede the Constitution under any circumstances.

ARTICLE 1: BILL OF RIGHTS

  1. All players are equal under the law regardless of sex, race, colour, creed or national origin.
  2. Every person shall be at liberty to speak, write or publish his opinions on any subject, being responsible for the abuse of that privilege; and no law shall ever be passed curtailing the liberty of speech or of the press.
  3. The people shall be secure in their persons, houses, papers and possessions, from all unreasonable seizures or searches, and no warrant to search any place, or to seize any person or thing, shall issue without describing them as near as may be, nor without probable cause, supported by oath or affirmation.
  4. Everyone has the right to life, liberty and security of the person and the right not to be deprived thereof except in accordance with the principles of fundamental justice.
  5. Any persons charged with an offence has the right to be presumed innocent until proven guilty according to law in a fair and public hearing by an independent and impartial tribunal.
  6. No person shall ever be imprisoned for debt.
  7. The citizens shall have the right, in a peaceable manner, to assemble together for their common good; and apply to those invested with the powers of government for redress of grievances or other purposes, by petition, address or remonstrance.
  8. Everyone has the freedom of peaceful assembly and association.
  9. The government shall do everything in its power to uphold these fundamental rights.
  10. All persons have the right to hold accountable the government should it be in violation of these fundamental rights.

ARTICLE 2: ESTABLISHMENT OF GOVERNMENT

  1. Her Majesty Queen Elizabeth II is the head of state of the server.
    1. Upon her passing, the matter of the next head of state shall be dealt with using the method outlined in the Succession to the Throne Act, 2013 enacted by the Government of Canada
    2. Her Majesty does not have the authority to directly alter the decisions of the government.
  2. The acting Head of State of the Server shall be the Governor General.
    1. The Governor General shall be the head of state whilst Her Majesty is outside of the server's realm.
    2. The Governor General must grant Royal Assent to any bill presented before him, after which the bill becomes law.
      1. EXCEPT if the Governor General does not find the legislation to act in the best interests’ of the people. In such a situation, the Governor General may withhold Royal Assent provided he notifies the Prime Minister.
  3. The Governor General shall be Hayward Peirce (bludyfingers).
  4. The head of the Government of the Server shall be the Prime Minister.
    1. The duty of the Prime Minister shall be to draft legislation which is then presented to the Governor General for Royal Assent.
    2. The Prime Minister shall be Jordan Bussanich (DrNick13).

  8. All legislation that is in force shall be made publicly available on the wiki.
    1. Draft legislation shall be made publicly available on the wiki once it reaches a state of sufficient completeness.
  9. In order for legislation to become law, one of following must be satisfied:
    1. The following conditions must be satisfied:
      1. The Prime Minister must present the legislation to the Governor General.
      2. The Governor General may then grant the legislation Royal Assent as outlined in (2.9.b).
    2. The following conditions must be satisfied:
      1. A piece of legislation drafted by an individual other than the Prime Minister may be submitted to the Prime Minister.
      2. The Prime Minister may submit the legislation from (2.9.b.i) to the Governor General for Royal Assent OR he may veto the legislation.
      3. If the vetoed legislation from (2.9.b.ii) bears the signatures of the majority of the active players on the server, it is passed directly to the Governor General for consideration of Royal Assent.
    3. The Governor General may call a server-wide referendum on any legislation he receives.
      1. The terms of the referendum shall be set out by the Governor General.

ARTICLE 3: CONSTITUTION AMENDMENTS

ARTICLE 4: PROVISIONS FOR AMENDING LEGISLATION

  1. The following applies only to portions of legislation that refer to this section:
    1. Legislation that refers to this section may be amended by the Governor General or by the Prime Minister by Royal Proclamation.
  2. All other legislation must be amended by following the usual legislation passage method.
