Sovereign Territories Act, 2016

LONG TITLE

An Act to Establish Frameworks for the Recognition of the Sovereignty of Extraterritorial Regions, 2016

PREAMBLE

Her Majesty, by and with the advice and consent of Parliament, enacts as follows:

ARTICLE 1 - DEFINITION OF A SOVEREIGN TERRITORY

  1. A Sovereign Territory is an Extraterritorial Region that meets the following criteria:
    1. The Extraterritorial Region shall not contain any above-ground development, or development above twenty (20) metres below sea level, that was constructed on behalf of the Government.
    2. An individual, or a group of individuals that do not represent the Government shall claim sovereignty over the Extraterritorial Region.
    3. The individual or group of individuals from (1.1.b) shall notify the Government of the existence of their Sovereign Territory.

ARTICLE 2 - RECOGNITION OF A SOVEREIGN TERRITORY

  1. The Government shall recognise any Sovereign Territory that was declared per (1.1.c) provided the following criteria are met:
    1. The Government does not hold an existing claim of the Sovereign Territory's land on or before the day at which the notification was issued.
    2. Another Sovereign Territory does not hold an existing claim of the Sovereign Territory's land on or before the day at which the notification was issued.
    3. The boundaries of the Sovereign Territory are clearly defined.
  2. Methods of defining the boundaries of a Sovereign Territory shall be done such that foreseeable changes in topography and development will not affect the definition of the Territory.

ARTICLE 3 - PROVISIONS FOR THE MOVEMENT OF CAPITAL

  1. The Government may, from time to time, enact provisions that place limitations on the flow of capital to and from Sovereign Territories for the purposes of protecting the interests of the Realm.
  2. The Government may inspect any persons or cargo re-entering the Realm from a Sovereign Territory.
    1. The Government may require persons returning from one or more Sovereign Territories declare any cargo for which they are in care of. Failure to declare any cargo can result in a fine not exceeding $10,000 and seizure of the undeclared cargo.

ARTICLE 4 - EMBASSIES

  1. The Government shall allow any Sovereign Territory to establish an Embassy on any property held by the Sovereign Territory within the borders of the Realm.
  2. The Government shall allow all persons, cargo and capital to pass freely through the Realm from a Sovereign Territory provided the only destination of the persons, cargo and/or capital is the Embassy of the Sovereign Territory.
  3. The property of an Embassy shall be considered an Extraterritorial Region.

ARTICLE 5 - COMMENCEMENT

  1. This Act comes into force on the day it receives Royal Assent.
