Potion Control Act

ARTICLE I - Definitions

  • Distributor - A business that deals with transporting and wholesaling potions from manufacturer to retailer.
  • Brewer - A person, or business, that produces potions for consumption.
  • Manufacturer - A business that brews or otherwise manufactures potions.
  • PCB - Potion Control Board (abbr.)
  • Potion - An beverage that is brewed with a brewing stand.
  • Retailer - A business that retailins intoxicating beverages to the general public.

ARTICLE II - Establishment of the Potion Control Board

  1. The Potion Control Board (henceforth referred to as the PCB) shall be established as a Business, subject to The Commerce and Currency Act.
  2. The PCB shall be a wholly owned subsidiary of Crown Corporation.

ARTICLE III - Duties of the Potion Control Board

  1. The PCB shall:
    1. Retail potions to the general public through a network of retail stores (subject to the Retail Establishments Act).
    2. Purchase potions wholesale from Manufacturers.
    3. Ensure that all procured potions meet or exceed safety standards set out by the PCB.
    4. Publish a price list and notify retailers of any changes to said list.
  2. The PCB shall not retail splash potions.
  3. The PCB shall not operate retail stores in Azure Coast under the PCB banner.
    1. The PCB may operate retail stores in Azure Coast under a separate banner.

ARTICLE IV - Manufacturing of Potions

  1. All players may manufacture potions for non-commercial, personal use.
  2. All players who wish to manufacture potions for commercial purposes shall obtain a Brewer's Licence.
    1. The PCB shall retail Brewers Licence's at all retail stores as well as at the PCB headquarters.
    2. Brewer's Licences shall cost no less than $200.00 per brewing location.
    3. A Brewer's Licence is valid only for a single brewing operation at a single location.
    4. A Brewer's Licence grants the holder a single Retail Licence (as defined in The Commerce and Currency Act) to operate a potion retail store at the site of the brewery.
      1. Such a retail outlet shall only retail potions of which were brewed at the co-located brewery.
    5. The Brewer's Licence fee may be altered without amending it using the method prescribed in the Constitution Act.

ARTICLE V - Retailing of Potions

  1. The PCB shall be the sole retailer of potions.
    1. EXCEPT where the PCB authorises a business or individual to retail potions as an agent on their behalf.
      1. Such a retailer shall retail potions at the same cost to the consumer as the PCB does in its store network.
    2. EXCEPT where an individual or business holds a Brewer's Licence (as outlined in IV.2.d).
    3. EXCEPT where an individual or business is located in Azure Coast.
      1. Such a retailer shall require only a general retail licence.
    4. EXCEPT where an individual or business is located in an International Port of Entry or International Port of Exit.
    5. EXCEPT where the Government grants an individual or business a Potion Retail Licence.
      1. Such a retailer may retail potions at any cost to the consumer.
    6. EXCEPT where the potions are to be consumed on the premises at which they are sold.
      1. Such a retailer shall procure all of their potions from the PCB at a wholesale discount of ninety (90) percent of the PCB consumer retail price.
      2. Such a retailer shall not retail potions for less than the cost of which they procured the potion.
  2. All potion retailers shall levy a $0.10 deposit on the potion bottle.
    1. This deposit shall be returned to the purchaser upon returning the bottle to a potion retailer.
  3. The Government may attach additional conditions, notwithstanding this Act, to any licence.

ARTICLE VI - Consumption of Potions

  1. All players have the right to consume potions.
    1. EXCEPT where otherwise prohibited by the landowner.
