Constitution Reform Act

PREAMBLE

WHEREAS the current Constitution does not allow for legislation to be enacted with effective consideration for time,

AND WHEREAS the current Constitution does not allow for adequate checks and balances to Government's power,

AND WHEREAS the current Constitution was written from the focal point of a single administrator,

THEREFORE be it resolved that the following is enacted:

ARTICLE 1 - AMENDMENTS TO THE CONSTITUTION ACT

  1. ARTICLE 2 of the Constitution Act is amended as follows:
    1. (2.3) is amended as follows:
      1. (2.3) The acting Head of State of the Server shall be the Governor General.
      2. (2.3.a) The Governor General shall be the head of state whilst Her Majesty is outside of the server's realm.
      3. (2.3.b) The Governor General must grant Royal Assent to any bill presented before him, after which the bill becomes law.
      4. (2.3.b.i) EXCEPT if the Governor General does not find the legislation to act in the best interests’ of the people. In such a situation, the Governor General may withhold Royal Assent provided he notifies the Prime Minister.
      5. (2.3.c) The Governor General shall be Hayward Peirce (bludyfingers).
    2. 2.4 is amended as follows:
      1. (2.4) The head of the Government of the Server shall be the Prime Minister.
      2. (2.4.a) The duty of the Prime Minister shall be to draft legislation which is then presented to the Governor General for Royal Assent.
      3. (2.4.b) The Prime Minister shall be Jordan Bussanich (DrNick13).
    3. (2.5) shall be repealed.
    4. (2.6) shall be repealed.
    5. (2.7) shall be repealed.
    6. (2.8) shall be is amended as follows:
      1. (2.8) All legislation that is in force shall be made publicly available on the wiki.
      2. (2.8.a) Draft legislation shall be made publicly available on the wiki once it reaches a state of sufficient completeness.
    7. (2.9) shall be created and will read as follows:
      1. (2.9) In order for legislation to become law, one of following must be satisfied:
      2. (2.9.a) The following conditions must be satisfied:
      3. (2.9.a.i) The Prime Minister must present the legislation to the Governor General.
      4. (2.9.a.ii) The Governor General may then grant the legislation Royal Assent as outlined in (2.9.b).
      5. (2.9.b) The following conditions must be satisfied:
      6. (2.9.b.i) A piece of legislation drafted by an individual other than the Prime Minister may be submitted to the Prime Minister.
      7. (2.9.b.ii) The Prime Minister may submit the legislation from (2.9.b.i) to the Governor General for Royal Assent OR he may veto the legislation.
      8. (2.9.b.iii) If the vetoed legislation from (2.9.b.ii) bears the signatures of the majority of the active players on the server, it is passed directly to the Governor General for consideration of Royal Assent.
      9. (2.9.c) The Governor General may call a server-wide referendum on any legislation he receives.
      10. (2.9.c.i) The terms of the referendum shall be set out by the Governor General.
  2. ARTICLE 3 of the Constitution Act shall be repealed.
  3. ARTICLE 4 of the Constitution Act shall be created and titled ‘PROVISIONS FOR AMENDING LEGISLATION’
    1. (4.1) The following applies only to portions of legislation that refer to this section:
    2. (4.1.a) Legislation that refers to this section may be amended by the Governor General or by the Prime Minister by Royal Proclamation.
    3. (4.2) All other legislation must be amended by following the usual legislation passage method.

ARTICLE 2 - COMMENCEMENT

  1. This Act comes into force on the day it receives Royal Assent.
